Arizona sheriff’s pink-underwear on male inmates may be illegal

Arizona’s Maricopa County sheriff Joe Arpaio is known for a number of controversial actions, especially against immigrants and hispanics, by detaining without crimes and punishing without conviction.   

The U.S Justice Department has found that Arpaio and his department has violated civil rights laws.  

Sheriff Arpaio likes to show his toughnesss by housing inmates in open air tent cities and, further, humiliates male inmates by forcing them to wear pink underwear.

The sheriff was sued after 2001 death of a mentally ill man who was forced to wear pink underwear.


Now, 9th U.S. Circuit Court of Appeals thinks forcing inmates, not convicted of a crime, to wear pink underwear may be unconstitutional.
"Unexplained and undefended, the dress-out in pink appears to be punishment without legal justification,"

Apparently, the U.S. Supreme Court has allowed jail officials to use unpleasant measures if they are legitimately concerned about the safety. However, according to a high court ruling, purposeless requirements can not be imposed on people who have not been convicted of a crime.

It would be better if Sheriff Joe Arpaio gave up his obsession with pink underwear and, instead, stuck to traditional, time honored law enforcement procedures.


A man who wants to see other men in pink underwear is revealing something about himself.
